1. Agreement To Terms
By accessing herefolk.com or subscribing to any HereFolk service plan, you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms") in full. If you do not agree with any part of these Terms, do not use our website or subscribe to our services.
These Terms constitute a legally binding agreement between you and HereFolk ("we," "us," or "our"). Please read them carefully before completing your purchase.
2. Description Of Service
HereFolk provides subscription-based telephone companionship and wellness check-in services delivered by trained human specialists. Depending on the plan selected, services include scheduled telephone calls, written call summaries delivered by email, mood and wellbeing tracking, safety awareness guidance, document reading assistance, and related family communication services as described on our pricing page at herefolk.com/pricing.
Our service is a telephone-based companionship and wellness service. We are not a medical provider, emergency response service, mental health provider, financial advisor, or legal services provider. Nothing communicated during our calls constitutes medical advice, financial advice, legal advice, or emergency assistance. In any emergency situation, customers and their loved ones should contact 911 or local emergency services immediately.
3. Subscription Plans And Billing
3.1 - Subscription Agreement
HereFolk services are sold on a month-to-month subscription basis. By completing your purchase you authorize HereFolk and our payment processor Lemon Squeezy to charge your payment method the applicable monthly subscription fee on a recurring basis beginning on your purchase date and continuing on the same date each subsequent month until you cancel.
You are authorizing recurring charges. Your subscription will continue and your card will be charged automatically each month until you cancel.
3.2 - Subscription Fees
Current subscription fees are:
- Guardian Essential: $39.00 per month
- Guardian Complete: $59.00 per month
- Guardian Premium: $89.00 per month
All fees are in United States Dollars. Fees are clearly displayed on our pricing page before you complete any purchase. By completing your purchase you confirm that you have reviewed and agree to the applicable fee.
3.3 - Billing Authorization
By subscribing you explicitly authorize HereFolk to charge your payment method the monthly subscription fee on a recurring basis. You confirm that you are the authorized holder of the payment method used. You confirm that you understand this is a recurring charge and not a one-time payment.
3.4 - Fee Changes
We reserve the right to change subscription fees with a minimum of 30 days written notice delivered to your registered email address. If you do not wish to continue at the new price you may cancel before the new fee takes effect with no penalty.
3.5 - Failed Payments
If your payment fails we will notify you by email and attempt to process payment again within 3 business days. If payment remains unsuccessful after two attempts your subscription will be paused until payment is resolved. We are not liable for any interruption in service resulting from a failed payment.
4. Free Trial And Satisfaction Guarantee
Where a free trial period is offered, no charge will be made during the trial period. At the end of the trial period your subscription will automatically convert to a paid plan and your payment method will be charged unless you cancel before the trial ends. We will send a reminder email 48 hours before your trial period ends.
We offer a 30-day satisfaction guarantee on all plans. If you are not satisfied with our service for any reason within the first 30 days of your paid subscription, contact us at billing@herefolk.com and we will issue a full refund of your first month's payment. This guarantee applies to your first month only and does not apply to subsequent billing periods.
5. Cancellation Policy
5.1 - How To Cancel
You may cancel your subscription at any time by:
- Emailing billing@herefolk.com with the subject line "Cancel My Subscription"
- Managing your subscription directly through your Lemon Squeezy customer portal.
We will confirm your cancellation by email within 24 hours of receiving your request.
5.2 - Cancellation Timing
Cancellations take effect at the end of your current billing period. You will continue to receive full service until that date. No partial refunds are issued for unused days within a billing period that has already been charged, except where the 30-day satisfaction guarantee applies as described in Section 4.
5.3 - No Cancellation Penalty
There is no cancellation fee, no notice period beyond the current billing cycle, and no penalty of any kind for cancelling your subscription.
6. Refund Policy
6.1 - 30-Day Guarantee
As described in Section 4, we offer a full refund of your first month's payment if requested within 30 days of your first paid charge.
6.2 - Beyond 30 Days
After the first 30 days, subscription fees are non-refundable except in the following circumstances:
- We were unable to deliver the agreed service due to circumstances within our control for a period exceeding 7 consecutive days
- You were charged after submitting a valid cancellation request in accordance with Section 5
6.3 - Refund Process
All approved refunds are processed within 5-10 business days to your original payment method. Refund requests must be submitted to billing@herefolk.com with your account email address and reason for the request.
6.4 - Chargeback Policy
We strongly encourage you to contact us directly at billing@herefolk.com before initiating any dispute or chargeback with your bank or card issuer. We resolve all legitimate billing concerns promptly and directly. Initiating a chargeback without first contacting us may result in immediate suspension of your account and may be disputed by HereFolk with full transaction documentation including your subscription authorization, service delivery records, and all communications.
If you have a billing concern of any kind, please email us first. We will resolve it within 24 hours.
7. Service Delivery And Expectations
7.1 - Call Scheduling
Calls are scheduled during your onboarding process at times mutually agreed upon by you and your HereFolk specialist. We will make every reasonable effort to deliver calls at the agreed time. Occasional rescheduling may be necessary due to unforeseen circumstances, in which case we will notify you promptly.
7.2 - Missed Calls
If your loved one does not answer a scheduled call we will retry once after 5 minutes. If the second attempt is also unanswered we will notify the primary family contact by call and email immediately.
7.3 - Call Summaries
Written call summaries are delivered by email to the registered family contact within 2 hours of each completed call. Summaries reflect the specialist's genuine observations and are not guaranteed to be exhaustive records of every topic discussed.
7.4 - Service Limitations
Our specialists are trained in companionship, wellness check-ins, and safety awareness. They are not trained medical professionals, licensed counselors, certified financial planners, or legal professionals. Any information shared during calls is for general awareness only and does not constitute professional advice of any kind.
7.5 - No Emergency Response
HereFolk is not an emergency response service. We do not monitor clients in real time, we do not have the ability to dispatch emergency services, and we cannot guarantee immediate response in any emergency situation. In any emergency, contact 911 immediately. Our missed call notification protocol is a courtesy service and does not replace proper emergency planning.
7.6 - Service Availability
We aim to deliver all scheduled calls as agreed. In the event of technical difficulties, specialist illness, or other unforeseen circumstances that prevent service delivery for more than 3 consecutive scheduled calls, we will offer a prorated credit to your account. This credit represents your sole remedy for service interruptions unless otherwise required by applicable law.
8. Customer Responsibilities
By subscribing to HereFolk you confirm and agree that:
- You are at least 18 years of age and legally capable of entering into this agreement
- You are the authorized holder of the payment method used to subscribe
- The information you provide during onboarding is accurate to the best of your knowledge
- You will notify us promptly of any changes to contact information, scheduling preferences, or the condition of your loved one that may affect service delivery
- You will not attempt to use our service for any purpose other than personal family wellness and companionship
- You will treat our specialists with courtesy and respect at all times
- You understand that our service is a supplement to - not a replacement for - regular family contact, professional medical care, and proper emergency planning
9. Acceptable Use
You agree not to use HereFolk services to:
- Harass, threaten, or abuse any HereFolk specialist or staff member
- Obtain professional medical, legal, or financial advice
- Substitute for emergency services or professional care
- Record calls without the explicit consent of all parties where required by applicable law
- Misrepresent your identity or the identity of the individual receiving calls
HereFolk reserves the right to terminate any subscription immediately and without refund where these provisions are violated.
10. Intellectual Property
All content on herefolk.com including text, design, graphics, logos, and service descriptions is the property of HereFolk and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from our website without our express written permission.
11. Limitation Of Liability
To the maximum extent permitted by applicable law, HereFolk's total liability to you for any claim arising from or related to these Terms or our service shall not exceed the total amount you paid to HereFolk in the 3 months immediately preceding the claim.
HereFolk is not liable for any indirect, incidental, consequential, or punitive damages of any kind including but not limited to loss of data, loss of revenue, emotional distress, or any outcome resulting from reliance on information shared during our calls.
Nothing in this section limits our liability for fraud, gross negligence, or any liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless HereFolk, its employees, specialists, and contractors from any claims, damages, losses, or expenses including reasonable legal fees arising from your violation of these Terms or your misuse of our service.
13. Privacy
Your use of HereFolk is also governed by our Privacy Policy available at herefolk.com/privacy. Our Privacy Policy is incorporated into these Terms by reference.
14. Modifications To Service And Terms
We reserve the right to modify these Terms at any time. When we make material changes we will notify you by email at least 14 days before the changes take effect. Continued use of our service after that date constitutes acceptance of the revised Terms. If you do not agree with any changes you may cancel your subscription before the new Terms take effect.
We also reserve the right to modify, suspend, or discontinue any aspect of our service at any time with reasonable notice to active subscribers.
15. Governing Law And Disputes
These Terms are governed by the laws of the United States. Any dispute arising from these Terms or your use of HereFolk that cannot be resolved through direct communication shall be subject to binding arbitration rather than court proceedings, except where prohibited by applicable law.
Before initiating any formal dispute process you agree to contact us at billing@herefolk.com and allow us 30 days to resolve the matter directly. We resolve all legitimate concerns promptly and in good faith.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms together with our Privacy Policy constitute the entire agreement between you and HereFolk regarding your use of our service and supersede all prior agreements or understandings.
